2. Acceptance
By downloading or using Surf Alarm, you agree to these Terms and Conditions. If you do not agree, do not use the app.
We may update these terms from time to time (see Section 16). Continued use after an update means you accept the new terms.
3. The service
Surf Alarm is a mobile app for iOS and Android. It lets you create alarms based on surf conditions at specific spots. When forecast data matches your alarm settings, you receive a push notification.
The app has a free tier and a Pro subscription. The Pro subscription includes a 30-day free trial for new users.
4. Eligibility
You must be at least 16 years old to use Surf Alarm. By creating an account, you confirm that you meet this requirement.
5. Subscription and payments
Free tier: Available to all users at no cost, with limited features.
Pro subscription: Unlocks all features. Pricing is shown in the app before you subscribe.
Trial: New Pro subscribers receive a 30-day free trial. Your subscription starts at the end of the trial period unless you cancel before it ends.
Billing: All payments are processed through the Apple App Store or Google Play. You agree to their payment terms when you subscribe. We do not handle your payment details directly.
Auto-renewal: Your Pro subscription renews automatically at the end of each billing period. To cancel, use the subscription management settings in the App Store or Google Play before the renewal date.
6. Refunds
All purchases are processed by Apple or Google. Refund requests must be submitted directly to them:
EU/EEA users retain all statutory rights under applicable consumer law, including rights that cannot be waived by contract.
7. Forecast accuracy
Surf Alarm displays forecast data sourced from Open-Meteo (wave and wind) and TideCheck (tides). This data is provided for informational purposes only.
We do not guarantee the accuracy, completeness, or timeliness of any forecast. Surf conditions can change rapidly and without notice. You are solely responsible for your own safety when surfing or engaging in any water activity. Do not rely on Surf Alarm as your only source of information before entering the water.
8. Push notifications
Surf Alarm sends push notifications through Expo's push notification service. Delivery is not guaranteed and depends on your device settings, internet connection, and the availability of third-party infrastructure.
You can disable notifications at any time in your device settings.
9. Third-party services
Surf Alarm relies on the following third-party services. Each is subject to its own terms and privacy policy:
- Clerk (authentication)
- Open-Meteo (wave and wind forecast data)
- TideCheck (tide data)
- RevenueCat (subscription management)
- Expo (push notifications)
We are not responsible for the availability or accuracy of these services.
10. Referral program
Surf Alarm offers an optional referral program. Referral rewards have no cash value and cannot be transferred or exchanged. We reserve the right to modify or discontinue the referral program at any time.
11. Prohibited uses
You may not:
- Use Surf Alarm for any unlawful purpose
- Attempt to reverse engineer, decompile, or extract the source code of the app
- Scrape or collect data from the app by automated means
- Impersonate another person or misrepresent your identity
- Transmit malicious code or interfere with the app's operation
We may terminate your access if you violate any of these rules.
12. Intellectual property
All content, design, code, and branding in Surf Alarm are owned by Motman Hodling or its licensors. You may not reproduce, distribute, or create derivative works without prior written permission.
13. Disclaimer of warranties
Surf Alarm is provided "as is" and "as available". We do not warrant that the app will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant that forecast data will be accurate or complete.
To the extent permitted by Dutch and EU law, we exclude all implied warranties.
14. Limitation of liability
To the maximum extent permitted by law, Motman Hodling's total liability for any claim arising out of or related to these terms or your use of Surf Alarm is limited to the amount you paid for the service in the 12 months before the claim arose.
We are not liable for:
- Indirect, incidental, or consequential damages
- Loss of data or loss of profit
- Injury, death, or property damage arising from surfing decisions based on forecast data
- Failure or delay in notification delivery
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited under Dutch law.
EU/EEA consumers retain all rights that cannot be excluded under mandatory consumer protection law.
15. Termination
You may stop using Surf Alarm and delete your account at any time.
We may suspend or terminate your access at any time if you violate these terms or if we discontinue the service. If we discontinue the service, we will give reasonable advance notice where possible.
16. Changes to these terms
We may update these terms from time to time. If we make material changes, we will notify you via the app or by email. The updated terms will show the new effective date at the top.
Continued use of Surf Alarm after the effective date of updated terms means you accept them.
17. Governing law and disputes
These terms are governed by Dutch law. Any disputes will be submitted to the competent court in Amsterdam, the Netherlands.
If you are a consumer resident in the EU/EEA, you may also bring proceedings in the courts of your country of residence. The European Commission's online dispute resolution platform is available at ec.europa.eu/consumers/odr.
